Question 2

Alyssa has just bought a high-tech bread maker from Basil for use in her restaurant in Taman Melawati. Consider each of the following alternative situation and advise Alyssa whether she can sue any of the following parties successfully under the Law of Contract: -

(a) Unknown to Basil, Alyssa believed that the high-tech bread maker could be programmed in advance to bake bread at a specific time of the day and shut down by itseld because an expert advisor in kitchen appliances, Cassie, had told her so. Alyssa was misinformed. The bread maker could not do that.

(b ) Alyssa asked asil whether he could advise her on which model of bread makers she should buy as she needed to bake sponge cakes as well as bread. She also said that if bread makers did not have such a dual function, she would rather buy an oven. Basil told Alyssa a lie when he said he was an expert in high-tech bread makers. He also said that the bread maker her recommended her to buy could bake sponge cakes as well as bread. The machine could not carry out that function.

(c ) After paying for the bread maker at the cash register counter of Basil's electrical appliances shop, Alyssa was shown a notice by the cashier that stated that customers who returned goods would only be entitled to a fill refund if they returned the goods within twenty-four hours.

Question 3

Dougal takes his girl friend, Ellie to a water park known as, Finny Friends' Lagoon Park where he buys tickets to allow them entry into the water park. Consider each of the following alternative situations and advise DOugal and Ellie whether they can sue successfully in accordance with the law of tort: -

(a) Dougal tries out the water slide in the water park. Contrary to the instructions on the notice board situated at the water slide, he adjust himself to face forwards on the slide, with his chest in contact with the water. His face collides with the ramp at the end of the slide resulting in injury to his jaw and nose.

(b ) Ellie goes swimming in the water park's swimming pool. A speed boat which is in a lake next to the swimming pool(also the property of the Finny Friends' Lagoon Park) gets out of the driver's control (an employee of the Park), mounting the pavement between thelake and the pool, and enters the pool where Ellie is swimming. The speed boat knocks Ellie down causing her yo injure her head and almost drown.

Goodcake Sdn Bhd operate a bakery in a commercial area known as Happy Park. Consider each of the following alternative situation and advise the parties involved whether can sue successfully: -

(a) Ishak is a doctor running his medical practice in a shop house next door. The noise from Goodcake Sdn Bhd's machine interferes with Ishak's practice as a doctor.

(b ) Goodcake Sdn Bhd employs Jeya as the front counter manager of thier shop. She slaps a customer, Kasmah, who accuses her of being dishonest. Would your answer be different if Jeya struck Kasmah beacuse jeya believed that Kasmah was stealing from the shop?

(c ) Khalid is a driver employed by Goodcake Sdn Bhd to make deliveries. One day, Khalid makes a detour from normal route to pick his son up from school. On the way to the school, he causes an accident involving Laila, who suffers injury.
