They want to be released. They are reservists who have served the time they are suppose to, but have not been released yet. Congress passed a no loss bill way back when that says in time of war, the military can without your approval resign you. But these guys are saying it is a breech of contract, blah blah. My friend Joe who just got back from Iraq a few months ago, and has already been told that come the first of 2005 they will be shipping out again (wereabouts unsure right now) had his time expire while in Iraq. Of course they renewed him for a year at that point, without his approval or anything. When he got back, he went in and signed up for four more years. (national guard) On the other hand, I have a friend, who signed up national guard, peace keeping forces, shortly after the 9/11 attack. She figured National guard she wasn't going anywhere. She admitted she did it only for the college money. Well, when she got called up, imagine the surprise when she is all of a sudden pregnant. Lost that baby, but when it was time to ship out, she was pregnant again. Lost that one as well (she has medical issues that hinder her ability to carry a baby) well in 6 months she was pregnant 4 times. Finally carried one full term. Now she is fighting to get out, cause she could never leave her baby. (there is more to the story, but you get the picture) Makes me sick! |

Stacy, I am sorry for your friend. I hope she loves that baby to the ends of the earth but to get out of war is not a reason to have one (or try 4 times). I pray that it was time for them anyway. She did sign up and in all contracts is the references to the United States Code and the authority of Congress. She may have signed up for the college money, as many did, but knkew the risk and accepted the consequences if called to active duty. She also did not due her homework. NG and reservists in the last 20 years have been called on a lot to go to war. I served for 20 years active. I still have friends active. Some got extended (involuntary) and some got approved retirements revoked. Some have returned from Iraq and completed retirement plans and others are over there right now. waiting for the return to either retire or separate. The folks suing, bluntly, are going to lose. Courts cannot start deciding who can be extended under war powers and who cannot. I times of war, which congress granted the power to the Pres., all can be involuntarily extended. All have. It is a risk taken when signing for the benefits and a must be honored when (involuntarily) extended. That is already well defined. The case about a month ago is not a precedent. It was acase of a man that had resigned a commission, many years earlier, but one right form had not been completed to take him off of the recall rolls. Vastly different case. |

My friend, I do not feel sorry for her. She had mentioned having a baby before ever joining, but felt it was to emotionally draining to try knowing her issues. So I am sure she does love the baby, but I have no pity for her, and if she is allowed to leave the military she needs a dishonorable discharge and IMHO she should have to pay back every penny she ever got! I have no sympathy for those kind of people. Like that Dr. Yoland Hewitt Vaughn who joined so they would send her through school. She got her doctors degree, and when the 91 war came along she refused to go. Trash! |
