All ready ordered it! Though what is nicer is that AOW (Avatars Of War) finally started sculpting stuff for us ratmen... That means if sales go well (and I think they really will), we'll be seeing more of this (yummy yummy) stuff!

It's not directly taking ideas from GW. If GW tried to sue everyone who has Dwarves, Elves, large rats, 1/2 man 1/2 beast people, Humans etc. they would be demolished. |

Anything that is similar enough can cause reason for a lawsuit if there could be "generated confusion" between products. It wouldn't be very hard to convince a judge that the likeness is so similar to the unique design of said ratmen or dwarfs is enough for the lawsuit. Especially Skaven; bipedal rodents in their likeness don't really exist anywhere else in that form (including weapon layouts and options). To us as Warhammer fans in the hobby, we can see clear differences, but imagine a jury filled with people who had never heard of Warhammer. Similarities would be too obvious. But I'm aware that there are dozens of said groups and companies that reproduce models clearly and obviously designed after Warhammer-based games and for GW to hunt them all down would probably result in a bigger loss of money. |

If I were a lawyer I would also point out the fact that GW takes the "intellectual" property off of D&D (how they actually started making miniatures) the point being that these ideas are floating around so much that no one "owns" them. It's like saying Arrowhead can sue Dasani because arrowhead made bottled water first, or that one costume co. can sue another because the former was making Witch costumes that the latter company also produce. |

Not really. Firstly food products from natural resources cannot be copyrighted, and "witch costumes" is a type of product. It's not the same because we're talking about artistic licences here in which there is a decently broad grey area. Apart from logos, a particular design of a specific witch costume can be strong grounds for a costume company to sue another. By the same token, a specific recipe or method of mixture that makes a type of cookie also falls into that category. Chocolate chip cookies in themselves (as are anthropomorphic rats) are not copyrighted. But a specific concoction that makes a specific type of chocolate chip cookies unique is. The particular artwork and specific style of that anthropomorphic rat race called "Skaven" is. To sell product of models that are so indistinctly similar to the same (especially without presenting your own methods of employing said models such as your own game and rules) would probably convince a judge. DC Comics is actually particular anal about it. They have threatened, attempted, though rarely succeeded in suing everyone and anyone they find, including City of Heroes, Heromachine, and I believe Deviant Art, whether or not you're even making money. To them, even creating a template in which a person can be capable of creating one of their heroes is grounds for a lawsuit! Edited by Writing Fighter, 13th October 2011 - 10:01 AM.

This is one reason why I really don't like legal systems, but I won't get on about that. Also I think that "Vermin Clan Lord" is far enough away from Skaven, and GW doesn't own the rights to bipedal rats AFAIK. |

The model is fantastic from what the one image shows. If anyone does pick one up, could you please post a few pictures of it so we can get some angles? Just to throw a few warp-tokens in on the legal debate: Were-rats are a common thing in D&D as I recall a primary antagonist in a Drizzt novel being a were-rat. So I doubt a suit over such a model would really hold much water. |

The fact that they use the word "clan" in connection with the product is enough for me. It's insanely clear that they are trying, deliberately, to make Skaven models by another name. Fight on, Writing Fighter. You are spot on with your (ignored) attempts to highlight what can and cannot be copyrighted. Nobody is saying another company cannot make ratmen. What is being said is that if you come close enough to the look and feel of someone else's vision of ratmen that people can easily see it is an attempt at copying, then there is a problem. Just ask Samsung about the Galaxy 10.1 vs iPad. "Tablet computer" is not owned, but the distinct look and feel of the iPad is. As much as I appreciate the skill required to make the models that AoW and others make, it sickens (yes, literally) me that they have to live off the hard work of others in this way. Make stuff in your own style, AoW! You are good enough to succeed without the wink-wink-nod-nod approach to skirting, barely, copyright. Edited by Sleboda, 13th October 2011 - 05:49 PM.
