A billion dollar judgment for peer to peer file sharing? The RIAA has officially become successful in shutting down peer-to-peer file sharing. I have previously discussed the legality of peer to peer file-sharing here. Last month, the RIAA’s lawsuit against Limewire resulted in a judgment of willful copyright infringement ordering them to pay $1 billion dollars for unlawful copying.

The formula the court used to reach this number is $750 dollars per copyright infringement multiplied by the estimated number of actual copyright infringement. This formula is based on strict statutory damages afforded to copyright owners in the U.S. Copyright Act. The RIAA apparently produced evidence that 200 million occurrences of copyright infringement occcured through Limewire’s service.

The court based its decision on the theory of secondary liability. Secondary liability means that although a party may not commit direct copyright infringement, they will be found liable for copyright infringement if they have played a significant role in direct infringement committed. So the court agreed that Limewire did not directly commit the infringement, but they provided the technology and encouraged users to share files with their peers.

Furthermore, the RIAA has asked the court to issue a permanent injunction against Limewire, preventing them from engaging in peer to peer file-sharing as a business model.

Limewire hopes to reach a compromise or settlement with the RIAA. However, the fact remains clear that peer to peer file sharing is a thing of the past. Consumers have been warned: engage in peer to peer file sharing and suffer the consequences.

They record your IP Adress. Its like an open invitation to get your ass sued by whatever company you're ripping off. not to mention all the info you leave behind for the trackers and hackers alike.

Luckily since I have two computers I can use my desktop as a "do whatever I want with it" computer and my laptop is the clean source. Keeps the dirty viruses that may sneak in from my personal stuff :lol:

Yeah but you gotta pay.

People ain't looking to pay for downloading things they think they can get for free. lol

I use Rapidshare. 40 bucks for 6 months is not bad. I get to download to my heart content knowing I will get shit for free and not have to worry about ever being caught.

I've used limewire for years downloading tons of music..thousands of songs and i have never really gotten anything from it. You just got to be smart enough to pick which files to download that aren't infected.
