    The other day i bought Diddy Kong Racing 64 and on the box it said that the characters banjo and conker were copyright of nintendo. so why can't nintendo just use those characters?

    I don't believe Nintendo ever owned the rights to them. That game wasn't even published by Nintendo, in the first place.
