    In case you forgot, the prices are:

    $10 for an N64 game
    $8 for an SNES, Genesis, Turbo Grafx-16, and Neo-Geo Color games
    $5 for an NES game

    I personally think the prices are way too high, especially considering how they aren't adding anything to the game to compensate for the prices (online play, or achievements, anyone?) Not to mention you could simply emulate the game on your computer and get things like online play and more all for free.

    But I don't think they're too high, I have never had trouble in picking a game because of their price. $10 for certain N64 games are a steal though, used N64 games at shops up here go for a usual price of $15, so that's pretty good. You can find NES games on the street though, so $5 is kinda high. Other than that I think they're fine.

    And I've never heard a story of anyone actually getting arrested for downloading a game before.

    Not if you own the game in real life.

    The copyright owner (ps it is not you as the owner of the game) holds exclusive rights to reproduction of the game, and the distribution of copies. So it may be considered illegal to even make a backup. It's certainly illegal to distribute copyrighted games (so acquiring a "backup" without making it yourself is supposedly legally impossible). When you buy some games, it says in the manual you can't make a copy. Whether or not this constitutes a legal EULA is sketchy.

    The exact laws surrounding the whole thing are fuzzy at best, but in a nutshell, I understand that you shouldn't have/be able to get a ROM image. It's defensible if you make it by yourself, for yourself, and haven't agreed to any EULA saying you won't do it.

    Homebrew ROMs are almost always legal to distribute, unless the author is a real tightass, and always legal to get directly from the author.

    If a copyright has expired or a game has been given a free license, it's legal.

    "You must delete the ROM within 24 hours" is a myth. Like I said before, if it's copyrighted, it's illegal to distribute (and download).

    Nintendo has pursued some lawsuits against ROM distribution websites. But unless you are some huge distributor, you don't really have to worry about criminal repercussions for downloading a few ROMs. You may get a cease-and-desist email depending on how you download them, though.

    Edit: haha, uh... the VC is too expensive. Doesn't matter how much the carts cost, the games shouldn't go over 5 bucks for the 'best' ones. It's pretty nutty how much Nintendo is trying to milk us.

    They definetly are too high. To spend $20 on a points card only to buy 2 N64 games is a little high, when you could just go to a local store where they sell used games, and get at least 4 for the same price. They should have made either the games or the points cheaper.

    You were basically right. You're pretty safe to make copies of your game for yourself, unless you consider "plz do not copy me :(" in the back of your manual an EULA.

    Nintendo, of course, makes it as hard as they possibly can to do this. Mostly because they are jerks, but partly because it's easy to distribute them once they're copied, and this hurts their business. They claim the ROM copiers themselves are illegal because they can be used for illegal things. I think they're full of shit on that one. Chainsaws can be used to kill people, and killing people is illegal, but chainsaws are legal... right?

    I'm reasonably sure emulators are legal, though! Let's all download emulators!
