Court halts closing of Bloomfield Hills Pine Lake school August 7, 2009 Plans to close Pine Lake Elementary School in the Bloomfield Hills School District were stopped Friday when Oakland County Circuit Court Judge Michael Warren ruled in favor of a group of parents who sought to prevent the closing. Advertisement “By closing Pine Lake School and leasing the deeded property to the Waterford School District the defendants (Bloomfield Hills Schools) have breached the charitable trust,” Warren’s ruling stated. The “charitable trust” is the core of the suit and refers to the original donation of the school property by Mae Callow in 1955. At the time, the property was given to the district for $1 with the stipulation that it only be used for a school to serve local children. Since then Pine Lake Elementary School has served students in the area of Middlebelt and Long Lake roads in West Bloomfield. But with district enrollment declining and costs rising, the district announced late last year it would close Pine Lake along with Hickory Grove Elementary School. Pine Lake was leased to the Waterford School District for its use on April 30. That generated a firestorm of protests from neighbors of the school and descendants of Callow who said it was a solid building needed in the neighborhood, and its closing would affect property values. They vowed to sue the district to prevent the closing, and they did on Feb. 26. No one from the school district was available Friday afternoon to respond to the decision. A key portion of the decision states, “At the time of the conveyance (donation of the property) the grantor and the defendants understood that the deed restriction required the defendants to only use the deeded property for a school that was governed, operated and owned by the defendants for students enrolled in the defendant’s district.” That precludes the district from using the property for anything but a school to serve Bloomfield Hills School District students. Parents and school representatives will meet before Warren on Wednesday, Aug. 12 for a “status conference” to determine what to do next. If I remember correctly, LPS did the same thing. Closed Washington and leased it to Plymouth-Canton. |

I think Rosedale? the older subdivision (with 70 year old homes) on south side of Plymouth Road between Merriman and Middlebelt? had some challenges because of the property being 'willed' to the district. Roskelly? |
