Senate Protocol Act (2015)
An Act to determine procedure and regulation for the function of the Senate.

Short Title

(1) This Act may be cited as the Senate Protocol Act (2015).

Reading, Discussion, and Amendment Period

(2) Any proposed legislation in the Senate shall commence at a First Reading that begins on submission of the legislation on the Senate floor by a sitting Senator.

(3) On submission of a request to ratify a presidential decision to enter, leave, or amend an interregional agreement, a First Reading shall commence.

(4) After a bill or ratification request has spent a minimum of 48 hours in a First Reading, the Speaker of the Senate may move the bill or ratification request to a Second Reading, if he deems that debate has progressed sufficiently at that stage.

(5) After a bill or ratification request has spent a minimum of 24 hours in a Second Reading, the Speaker of the Senate may move the bill or ratification request to an additional Reading at his discretion. A bill or ratification request must be moved to an additional Reading if during the Second Reading or the Voting Period a motion to move to an additional Reading is carried by a majority of the Senate.

(6) After a bill or ratification request has spent a minimum of 24 hours in a Second or any subsequent Reading, and no motion for an additional Reading is pending, the Speaker of the Senate may conclude the debate stage for the bill or ratification request, and commence the Voting Period by calling a Vote.

(7) A bill shall be tabled if during a legislative Reading a motion to table by a sitting Senator is carried by two thirds of the Senate.

(8) In circumstances where the President deems that an urgent decision is required with regards to leaving an alliance, treaty or other interregional agreement, such a proposal shall be immediately considered with no time constraints.

Voting Period

(9) Votes may only be cast by sitting Senators, or designated substitutes for sitting Senators, at the time the Voting Period commences.

(10) If all sitting Senators have voted on a bill or ratification request, the Voting period shall be closed.

(11) If any bill or ratification request in the Voting Period has definitely passed and remains open after 72 hours, the Voting Period shall be closed.

(12) If any bill or ratification request in the Voting Period has failed to pass and remains open after 120 hours, the Voting Period shall be closed.

(13) A request to enter, leave, or amend an interregional agreements requires the support of at least two-thirds of the sitting Senators to be ratified.

(14) Bills in the Voting Period may be forwarded to the President for a signature or veto as soon as a definite outcome is achieved.

Senate Protocol and Decorum

(15) Posts in the Senate shall be formal and civil at all times, so as to correctly observe the official legislative nature of the Senate body, and shall be relevant to the topic being discussed.

(16) Posts made during any Voting Period shall be required to be of direct relevance to the vote.

(17) Offending Senators or citizens with permission to speak shall be warned by the Speaker of the Senate for a first offense.

(18) For a second offense, the Speaker may suspend the offender from the Senate for a time period not in excess of 120 hours.

(19) Suspension from the Senate shall be hereby defined as 'suspension from all Senatorial duties and privileges, including the right to vote and post in the Senate'.

Office of the Speaker of the Senate

(21) At the beginning of every term and whenever the Office is vacant, a Nomination Period shall commence during which any sitting Senator may nominate any other sitting Senator for the Office of the Speaker of the Senate.

(22) Only nominees who accept their nomination will be included on the ballot.

(23) Following a minimum of 48 hours in the Nomination Period a vote shall commence in which every sitting Senator may vote for their preferred Candidate.

(24) Any Candidate that is confirmed by a majority of the active sitting Senators shall assume the vacant Office of the Speaker of the Senate.

(25) Should no Candidate receive the amount of votes required to assume the Office of the Speaker, a further Nomination Period shall be initiated for a minimum of 24 hours. Following the additional Nomination Period another vote shall commence in which every sitting Senator may again vote for their preferred Candidate. Should no candidate receive the required majority to assume the Office of the Speaker on the second ballot the President shall have one vote.

(26) Any Senator may motion at any time during the Nomination or Voting Period to immediately appoint a specific Candidate to the Office of Speaker. To succeed this motion must be carried by unanimous consent.

(27) Should it become clear that the Office of the Speaker is likely to become vacant during a term, the Senators may select a Speaker-elect using the process provided above. The Speaker-elect shall assume the Office once it becomes vacant.

(28) The Speaker of the Senate may nominate one Senator to serve as the Deputy Speaker of the Senate, with such responsibilities as delegated to him by the Speaker of the Senate, and as required by legislation.

(29) The Deputy Speaker may undertake the duties of the Speaker if the Speaker has been absent for a period of at least 48 hours, unless an objection is lodged by another Senator, in which case, a vote on removal of the Speaker shall be immediately held.

(29b) Should the Deputy Speaker be inactive in addition to the Speaker, while the inactivity is ongoing any Senator may undertake the Duties of the Speaker.

Duties and Powers of the Office of the Speaker of the Senate

(30) It shall be the responsibility of the Speaker of the Senate to pin all currently debated legislation on the Senate floor, and to move proposed legislation as per the legislative process detailed above.

(31) The Speaker of the Senate shall be required to forward any Senate legislation that passes to the President for signature, veto, or reservation for referendum.

(32) The Speaker of the Senate shall be required to maintain reasonable following of Senate protocol and decorum.

Removal of the Speaker of the Senate

(33) The Speaker of the Senate shall be removed from the Speakership if a motion to that effect by a sitting Senator is carried by a majority of the Senate.

(34) In the event the Speaker of the Senate is removed from the Office of the Speaker, the Deputy Speaker of the Senate shall automatically also be removed.

Senatorial absences

(35) If a Senator has declared an absence, the Senator may appoint a substitute for the duration of the declared absence.

(36) Any declared Senatorial absence may not exceed 14 days, unless a one time motion to extend the maximum allowed length of a specific absence by 7 days has been carried by a majority of the Senate.

(37) During the absence of a Senator, the Senatorial substitute shall be granted the full responsibilities and privileges granted to elected Senators.

(38) Senatorial substitutes shall be liable to replacement by the Speaker of the Senate if they fail to undertake their temporary Senatorial duties.

(39) Should the Speaker of the Senate declare an absence the powers and duties of the Office of the Speaker shall fall to the Deputy Speaker for the duration of the absence.

Removal of Senators

(40) If a Senator fails to post in the Senate for at least 5 full days, without having given proper notice of absence, said Senator may be removed by a majority vote of the Senate.

(41) A Senator may only be removed as per the provisions of either this document or the Constitution of Europeia.

Miscellaneous Provisions

(42) Anyone with speaking privilege in the Senate may move to appeal a decision by the Speaker. If followed by a second, a Senate vote shall be held whether or not to overturn and/or replace the decision of the Speaker. A simple majority will be required to overturn the decision.

(43) A Senator may move to make a resolution. A resolution shall be non-binding. If another Senator seconds the motion, the Senate shall enter a Debate Period at a First Reading at which time all legislative provisions written in this act for legislation shall apply for the resolution.

Senate Speaking Rights

(44) General permission to speak in the main Senate forum shall be restricted to only those individuals listed below.

a. current Senators;
b. the President;
c. the Vice President;
d. the Supreme Chancellors.

(45) Invitations may be issued to permit additional individuals to speak in the main Senate forum; however, such invitations shall be subject to revocation by the Speaker of the Senate, at his discretion, and speaking privileges granted thereof shall be limited to the specific matters pertaining to the invitation.

a. The Chair of the Citizens' Assembly shall have a standing invitation to speak in the Senate on any matter under consideration;
b. The primary author of any legislation before the Senate that originated in the Citizens' Assembly shall enjoy a standing invitation to speak in the Senate; this invitation shall be limited solely to the the continuing discussion of the legislation they originated within the Citizens' Assembly;
c. Cabinet members shall have a standing invitation to speak in the Senate when discussing matters concerning their position;
d. The World Assembly Delegate shall have a standing invitation to speak in the Senate when discussing matters concerning the World Assembly and Europeia's representation therein; and
e. Individual Senators shall be permitted to invite additional individuals to speak in the main Senate forum at their discretion.

(46) The Speaker of the Senate shall have the right to impose restrictions on speech in other subfora of the main Senate body as not already determined above, at his discretion. These restrictions must, however, be specified in a reasonable manner, and must not exceed the restrictions placed upon speech in the main Senate forum.

Repeal

(47) The Parliamentary Procedures Act (2012) is hereby repealed in its entirety.
