This amendment allows the executive to call elections with the signatures of 12 citizens. Now, when this law says "in addition to himself" does that mean the President himself may be one of the twelve? This might seem like a softball, but I just want to be sure in case it ever happens. My specific stake is that my office shall be responsible for administering such elections. |

This question depends on the definition of "in addition to," which the Court interprets to mean "including." After deliberation, the Court rules that the President may be one of the 12. |

Since it was asked for by citizens in the Public Gallery: Justices Asperta and Bootskitten concurred with the opinion. After that, the Chief Justice issued the opinion, seeing as a majority of Justices had agreed. I do not concur with the opinion issued by the Chief Justice, because "in addition to" does not, under any circumstances, mean "including". I take further issue because under s. 3(1) of the Judicature Bill (2011), the request for an Advisory Opinion should not have been granted. [hide=s. 3(1) of the Judicature Bill (2011)](1) The Court shall only entertain a request for an Advisory Opinion if the requesting person has a specific stake in the legal controversy -- simply being a concerned citizen is not a "specific" stake, but a citizen seeking clarification of the law before taking a proposed course of action him/herself does have such a specific stake. The Attorney General is always deemed to have the "specific stake" required by this subsection.[/hide] |
