Popular Senate Size Amendment (2018)
An Act to introduce a popular vote for Senate Size to be held concurrently with the General Election.

Short Title

(1) This Act may be cited as the Popular Senate Size Amendment (2018).

Removal of Electoral Panel

(2) (6), (7), (8), and (9) of the Elections Act (2015) shall be removed.

Introduction of new System

(3) Following (5) of the Elections Act (2015) under the Heading "Size of the Senate" the following shall be added:
Quote:
 
(6) The number of seats available in a General Election shall be decided by a vote held for this purpose concurrently with the Voting Period of the General Election.

(7) The vote regarding the number of seats shall be structured as follows:
(i) Each Citizen shall have one vote.
(ii) The options available to vote for shall be the options for numbers of seats of the Senate with the lowest option being 5 Seats increasing in increments of a single seat per option to the highest option of 10 Seats, unless the outgoing Senate has approved a motion with an absolute majority to increase the options for number of seats.
(iii) Each possible variant of two adjacent options (i.e. 5 Seats and 6 Seats, 6 Seats and 7 Seats, 7 Seats and 8 Seats etc.) shall be deemed to be a set, creating overlapping sets.

(8) The general outcome of the vote regarding the number of seats shall be decided as follows:
(i) The total number of votes all options within each set have received at the end of the voting period shall be added together. The set with the largest number of votes shall be deemed to have won.
(ii) Within the winning set, the option with the largest number of votes shall be deemed to have won.
(iii) If the number of seats determined by the vote is higher than the number of Candidates minus two then the number of seats shall be reduced to the number of Candidates minus two with an absolute minimum of 5 seats.

(9) Conflicts within the results of the vote shall be decided as follows:

(i) Ties within a winning set and associated conflicts shall be decided as follows:
(a) Ties within the winning set shall be decided by comparing two options for number of seats outside the winning set with the two options being those immediately adjacent to the options for number of seats within the winning set.
(-) The tie shall be decided in favor of the tied option with the higher number of seats in the winning set if the option with a higher number of seats being compared has a higher number of votes than the option with a lower number of seats being compared.
(-) The tie shall be decided in favor of the tied option with the lower number of seats in the winning set if the option with a lower number of seats being compared has a higher number of votes than the option with a higher number of seats being compared.
(b) Should there be a tie within a winning set and the two immediately adjacent options for number of seats outside the winning set are tied then the two options outside the winning set being compared shall each be moved in increments of one option away from the winning set until the two options being compared are no longer tied.
(c) Options outside those available to be voted for (e.g. 4) may be compared in cases of ties within a winning set and shall be considered to have a vote tally of zero votes.
(d) Should all options to be compared if there is a tie within a winning set be tied then the tie within the winning set shall be decided in favor of the lower number of seats.

(ii) Ties between sets and associated conflicts shall be decided as follows:
(a) Ties between sets shall be decided by adding the number of votes for each tied set to the number of votes for both options for number of seats immediately adjacent to each tied set. The tie shall be decided in favor of the set with the highest number of votes after the inclusion.
(b) Should there be a tie between sets with the number of votes of adjacent options included, then the number of options added shall be increased by two options, one immediately adjacent with a higher number of seats and one immediately adjacent with a lower number of seats, until the sets are no longer tied.
(c) The set in favor of which the tie is decided shall only contain those options for number of seats originally included in that set.
(d) Options outside those available to be voted for (e.g. 4) may be included and shall be considered to have a vote tally of zero votes.
(e) Ties between sets that can not be resolved in the standard manner shall be decided in favor of the set closest to the average possible number of seats rounded down to the nearest integer.


Number of Votes in the General Election

(4) (20) of the Elections Act (2015) shall be amended to the following:

(20) In elections where the number of positions available is known prior to the opening of the vote, each voter shall be provided the number of votes for allocation to candidates equal to the number of positions available. In elections where the number of positions is unknown prior to the opening of the vote, the number of votes for allocation to candidates shall be equal to two thirds the number of Candidates but at least the minimum number of positions and at most the maximum number of positions given the number of Candidates.
